Pursuant to an Order of Sale entered in United States vs. defendants, in Civil Action No. 3:09-CV-65, United States District Court of the Southern District of Texas, of the United States will offer to sell at public auction ½ interest, to the highest bidder, according to law and pursuant to the terms and conditions set in herein, the property described below:

Description of Property: Commercial real estate with 1,600 sq. ft.; located on .03329 acres in Brazoria County; built in 1959; listed as Property ID#241922 in Brazoria County Appraisal District, has concrete paving for parking, and it is currently being used as a doctor’s office.

Legal Description: 0.34 acres of land, being part of the commercial reserve in Block 2 of Regency Park Subdivision in the City of Pearland, Texas, according to the plat recorded in Volume 9, Pages 1 and 2, Plat Records, Brazoria County, Texas, and being more particularly described as follows:

BEGINNING at an iron rod set for the most Southeast corner of the herein described tract on the Northeast right-of-way line of F.M. Road No. 518, said point being located North 58 deg. 26 min. West – 381.2 feet from its intersection with the Northwest right-of-way line of Byron Avenue;

THENCE North 58 deg. 26 min. west along the Northeast right-of-way line of F.M. 518 a distance of 100.4 feet, called 100.0 feet, to an iron rod for corner;

THENCE North 31 deg. 34 min. East – 155.5 feet to a 1 inch iron pipe for corner in the Southerly line of Lot 6, Block 2 of the aforementioned subdivision;

THENCE in a Southeasterly direction around curve to the left having a radius of 2690.0 feet, an arc distance of 79.8 feet to the point of tangent;

THENCE South 58 deg. 26 min. East – 21.45 feet to an iron rod for corner;

THENCE South 31 deg. 34 min. West – 145.0 feet to the PLACE OF BEGINNING and containing 0.34 acres of land, and being the same property as described in Volume 846, Page 406, of the Deed Records, Volume 912, Page 586, of the Deed Records, Volume 913, Page 180, of the Deed Records, and Volume 1214, Page 246, of the Deed Records all in Brazoria County, Texas.

The Terms of Payment: The property will be offered for sale at public auction and sold to the highest bidder, under the terms and conditions of sale that are set forth below, foreclosing all of the right, title and interest of the defendant, the taxpayer.

The successful bidder shall be required to deposit at the time of the sale with the Internal Revenue Service, a minimum of ten percent (10%) of the bid, with the deposit to be made by certified check or cashier’s check, payable to United States District Court, immediately upon the real property being struck and awarded to the highest and best bidder. Before being permitted to bid at the sale, bidders shall display to the Internal Revenue Service proof that they are able to comply with this requirement. No bids will be received from any one who has not presented that proof.

The balance of the purchase price for the property shall be paid to the Internal Revenue Service, Property Appraisal and Liquidation Specialist, within fifteen (15) days after the date the bid is accepted, by a certified or cashier’s check, payable to the United States District Court. If the successful bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to cover the expenses of the sale, with any amount remaining to be applied to the federal tax liabilities of the defendant, taxpayer. The real property shall be again offered for sale under the terms and conditions of the order of sale.

The sale of the property will confirm itself within 20 days from the date of the sale, unless someone objects to the sale. Upon the confirmation of the sale, the Internal Revenue Service shall issue the buyer a deed – not a quit claim – conveying full title to the buyer and warranting against claims under the Service. On confirmation of the sale, all rights, interests in, liens against, or claims to this property that are held or asserted by any parties to this action, are discharged and extinguished. The ½ interest in the property will be sold without appraisal, subject to any unpaid property taxes or other priority interests to satisfy the Judgment of Title and Possession. The government reserves the right to reject any bids and to withdraw the property from sale. The sale shall be subject to building lines if established, all laws, ordinances, and governmental regulation (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any.

The property is offered for sale “where is” and “as is” and without recourse against the United States. The United States makes no guaranty or warranty of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation. The United States may bid as a creditor against its judgments without tender of cash.

Form of Payment: All payments must be by cash, certified check, cashiers or treasurer's check or by a United States postal, bank, express, or telegraph money order. Make check or money order payable to the United States District Court.
